Law Series: The Power of Clemency in Death Penalty Cases

Austin Sarat, William Nelson Cromwell Professor of Jurisprudence and 
Political Science at Amherst College and Five College Fortieth 
Anniversary Professor, delivers the 5th lecture in the Challenges to 
Legal Thought in the 21st Century Series on Wednesday Nov 8th, 
entitled "Lawful; Lawlessness: Clemency and Sovereignty."

This talk will ask what we can learn about sovereign power in the 
modern era by examining one of its most vivid instantiations--namely 
the power of chief executives to grant clemency in capital cases. It 
will describe a form of sovereign power called "lawful lawlessness" 
and ask how that power challenges existing ideas of and commitments 
to the rule of law.
